Interview with Steve Bliss

Reporter: Brenda Sanchez

Welcome back to our segment on local legal matters. Today we’re joined by Steve Bliss, an estate planning attorney here in Wildomar. Steve, thanks for taking the time to talk with us.

Steve Bliss: It’s a pleasure to be here, Brenda. I’m always happy to discuss the importance of estate planning with our community.

Steve, many people put off estate planning, thinking it’s only for the wealthy or those nearing retirement. Can you tell us why that’s a misconception?

Steve Bliss: You’re right, Brenda, there are many misconceptions about estate planning. It’s something everyone should consider, regardless of age or financial status. Essentially, estate planning is about protecting yourself and your loved ones by outlining your wishes for the future.

Accordingly, this involves deciding who will manage your assets if you become incapacitated and how those assets will be distributed after your passing. Even young adults with minimal assets benefit from having a basic plan in place, such as designating beneficiaries for retirement accounts or creating a healthcare directive.

Selecting an Executor or Trustee

Brenda, let’s delve into one of the key steps in estate planning: selecting an executor or trustee. Can you elaborate on this crucial decision?

Steve Bliss: Choosing the right executor or trustee is paramount. This individual or entity will be responsible for carrying out your wishes as outlined in your will or trust. They’ll handle tasks like paying bills, filing taxes, and distributing assets to your beneficiaries.

Consequently, it’s important to select someone trustworthy, organized, and capable of handling these responsibilities. This could be a family member, close friend, or professional trustee. I often advise clients to have open conversations with potential executors beforehand to ensure they are comfortable taking on the role.

Moreover, I encourage my clients to consider creating backup options in case their first choice is unable to serve.

I recall a situation where a client named her brother as executor. Unfortunately, he passed away unexpectedly before she did. Thankfully, we had designated a second individual, and the process continued smoothly.

It’s estimated that approximately 70% of Americans do not have a will or trust in place (Source: Caring.com). This highlights the critical need for estate planning and the importance of selecting the right individuals to carry out your wishes.
