Interview with Steve Bliss

“Essentially, a trust is a legal entity that holds and manages assets for the benefit of someone else,” Steve explains. “It’s created by a grantor, who transfers ownership of assets like property or investments into the trust. A trustee then manages these assets according to the grantor’s instructions outlined in the trust document. The beneficiaries, who are designated by the grantor, ultimately receive the benefits from the trust assets.”

“Trusts offer numerous advantages,” Steve continues. “They can help avoid probate, which is a lengthy and often costly legal process. Moreover, they provide privacy because the terms of the trust are not public record. Trusts can also be used for asset protection, charitable giving, and even providing for minor children or beneficiaries with special needs.”

Choosing The Right Trust

That’s incredibly helpful information. Steve, given all these benefits, how does someone choose the right type of trust for their specific needs?

“That’s a great question,” Steve responds. “There are several types of trusts, each with its own unique purpose and features. For instance, a Revocable Living Trust is very common. It allows the grantor to maintain control over assets during their lifetime while avoiding probate upon death. Conversely, an Irrevocable Trust offers greater asset protection but relinquishes grantor control. The best type of trust depends on individual circumstances, goals, and financial situation.”

Navigating Probate

“Many people are concerned about probate,” Tiffany interjects. “Can you elaborate on how a trust helps avoid this process?

“Probate is essentially the court-supervised process of validating a will and distributing assets after someone passes away,” Steve explains. “It can be time-consuming, expensive, and public. A properly structured trust bypasses probate entirely. Since the assets are already held by the trust, they are distributed to beneficiaries according to the trust terms without needing court intervention.”

“Let me give you an example,” Steve continues. “Imagine a couple creates a joint revocable living trust and places their home and other assets into it. Upon the death of the first spouse, the surviving spouse inherits the assets seamlessly, as per the trust instructions. There’s no need for probate because the assets already belong to the trust.”

“Avoiding probate can be a huge relief for families during an already difficult time,” Tiffany adds.
