Could you explain one of the key steps involved in the probate process?

Certainly. One crucial step is marshaling the estate assets. This involves meticulously inventorying all of a decedent’s possessions and identifying their value.

Consequently, it requires a thorough examination of bank accounts, investment portfolios, real estate holdings, personal property, and even digital assets. Moreover, probate law mandates that an Inventory and Appraisal (Forms DE-160/161) be filed with the court detailing these assets and their respective valuations.

This step is essential for transparency and ensuring that all parties involved have a clear understanding of what’s included in the estate. It also helps determine if any taxes are owed on the estate.

Notwithstanding its importance, I’ve encountered instances where family members disagree about the value of certain assets, leading to delays in the probate process. In one instance, siblings argued over the worth of a collection of vintage cars, ultimately requiring an independent appraisal to resolve the dispute.

Have you ever faced challenges while marshaling estate assets?

I recall a case where a client’s deceased father had meticulously hidden cash throughout his home. It took weeks of searching and uncovering secret compartments before we located all the funds. Ordinarily, finding hidden assets isn’t an issue, but in this case, it highlighted the importance of thoroughness and attention to detail.

According to a recent study by the American Bar Association, approximately 20% of probate cases involve disputes over asset valuation, underscoring the need for accurate and impartial appraisals.
