Notwithstanding the emotional aspect, it’s essential to select someone who has a good understanding of finances and legal matters. I often advise clients to have open conversations with potential executors about their willingness and ability to take on this role.

Furthermore, it’s important to remember that an executor or trustee doesn’t necessarily need to be a family member. A close friend, financial advisor, or attorney can also serve in this capacity.

I recall one instance where a client named his brother as executor without fully considering the complexities involved. Unfortunately, the brother lacked financial literacy and struggled to manage the estate effectively. This led to unnecessary delays and disagreements among family members. Had we discussed these potential challenges beforehand, we could have potentially chosen a more suitable individual.

According to a study by Caring.com, over 60% of Americans do not have a will or living trust in place. Selecting an executor is one of the most critical steps individuals can take to ensure their final wishes are honored and minimize potential family conflicts.
