Certainly. A Special Needs Trust (SNT) is designed specifically to provide financial support for individuals with disabilities without jeopardizing their eligibility for government benefits like Supplemental Security Income (SSI) or Medi-Cal.

These trusts can be established as either first-party, funded with the beneficiary’s own assets, or third-party, funded by family members or other individuals. The trustee manages the funds and distributes them to cover expenses that aren’t typically covered by government programs, such as supplemental medical care, assistive devices, education, and recreational activities.

Accordingly, an SNT allows beneficiaries with disabilities to enjoy a higher quality of life without sacrificing essential benefits. It’s crucial for families to understand the complexities of these trusts and seek professional guidance from an experienced probate attorney.

Navigating the Challenges of Special Needs Trusts

You mentioned that it’s important to consult with an expert. What are some of the challenges families might face when setting up or managing a Special Needs Trust?

One common challenge is ensuring the trust complies with all applicable federal and state regulations. The rules governing SNTs can be quite complex, and even a minor misstep could jeopardize the beneficiary’s eligibility for government benefits.

Moreover, choosing the right trustee is crucial. The trustee must be trustworthy, financially responsible, and knowledgeable about the needs of the beneficiary. In my experience, it’s often best to appoint a professional trustee or co-trustee who has expertise in managing SNTs.

I recall one instance where a family came to me after setting up an SNT on their own. Unfortunately, they had inadvertently structured the trust in a way that made the beneficiary ineligible for SSI. We were able to correct the situation, but it highlighted the importance of seeking professional guidance from the outset.
